The project is located in Tellapur, on the periphery of Hyderabad, and the penalty will continue to accrue from the original deadline set for compliance until the developer fulfils the authority's orders.
TS-RERA initiated the proceedings after the promoter failed to implement the directions contained in an adjudication order arising from complaints by homebuyers related to project delays and non-adherence to contractual obligations. In its recent order, the authority observed that despite repeated opportunities and clear instructions, the developer had not complied with the stipulated directives within the prescribed timelines. As a result, the regulator invoked its powers under the Real Estate (Regulation and Development) Act, 2016, to impose a monetary penalty on the promoter.
The penalty will accrue at the rate set by the authority starting from the first day after the deadline for compliance until the promoter fully adheres to the earlier adjudication order. TS-RERA has emphasised that continuous non-compliance could lead to enhanced financial liability and further regulatory action, including potential enforcement measures against the project's registration or related licences, if warranted.
The Green Space Bagiratha project has been under scrutiny from homebuyers who have raised concerns about delays in project execution and fulfillment of promised deliverables. TS-RERA's adjudication process, which seeks to address buyer complaints and enforce contractual compliance by promoters, resulted in specific directives that the regulator expects to be implemented within defined timelines. The promoter's failure to comply triggered the penalty mechanism provided under the Act.
