The Navi Mumbai Municipal Corporation (NMMC) has implemented strict measures to curb noise and air pollution caused by ongoing construction and redevelopment projects within its jurisdiction. In response to citizen complaints and a directive from the Mumbai High Court, NMMC Commissioner Dr. Kailas Shinde formed a committee to develop a Standard Operating Procedure (SOP) for pollution control and safe blasting practices. The SOP, approved on July 26, 2024, includes guidelines for monitoring construction sites, with local officers required to conduct weekly inspections until foundation work is complete. Violations will result in legal action under relevant laws, reinforcing NMMC's commitment to minimizing environmental impact and ensuring public safety.
Various construction and redevelopment projects are underway in the Navi Mumbai Municipal Corporation (NMMC) jurisdiction. These activities have led to frequent complaints from citizens and public representatives regarding noise pollution, air pollution, and issues related to blasting operations.
The Hon'ble High Court of Mumbai, in Suo Moto Public Interest Litigation No. 3/2023, issued an order on December 11, 2023, mandating measures to reduce air pollution. In response, NMMC Commissioner Dr. Kailas Shinde issued an order on April 24, 2024, to form a committee under the chairmanship of Additional Commissioner (2) Mr. Shirish Ardavad, comprising expert members to develop a 'Standard Operating Procedure (SOP)' to address these issues permanently.
After multiple meetings, the committee developed an SOP for air and noise pollution control and precautions to be taken during excavation/blasting for multi-story basement constructions. This SOP, along with proposals for punitive actions concerning air and noise pollution at construction sites, was approved by Commissioner Dr. Kailas Shinde on July 26, 2024, under Resolution No. 6452.
In line with this, an SOP has been prepared to control noise and air pollution and blasting activities at ongoing construction sites within the NMMC jurisdiction. The SOP also includes guidelines for punitive actions against violations. The circular was approved by the Commissioner on August 1, 2024.
To monitor ongoing construction projects, a task force has been appointed. As per the circular, local department officers must conduct on-site inspections of all excavation/construction projects in their jurisdiction at least once a week until the foundation work is completed. An updated report of these inspections must be submitted to Assistant Director of Urban Planning, Mr. Somnath Kekaan.
If any violations of terms and conditions are found during these inspections, legal action will be taken against the permit holder under the Maharashtra Regional and Town Planning Act, 1966, and the Maharashtra Municipal Corporations Act, 1949, as well as per the provisions of the circular, with prior approval from the Commissioner.
NMMC is taking strict measures to prevent noise and air pollution caused by construction projects, to minimize the inconvenience to citizens due to excavation/blasting, and to avoid potential accidents at project sites.
