The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has recently referred 250 cases related to home possession to the courts of adjudicating officers in Lucknow and Gautam Budh Nagar. Among the 250 cases, around 130 have been sent to the adjudicating officer in Lucknow, while the remaining 120 cases are with the officer in Gautam Budh Nagar. UP-RERA chairman Sanjay Bhoosreddy highlighted that many developers have been delaying possession despite earlier orders from the authority. As a result, the adjudicating officers have been empowered under Rule-24 of the UP-RERA 2018 regulations to expedite the resolution of these issues.

The adjudicating officers will utilize the powers granted under the Code of Civil Procedure to ensure compliance. This includes the ability to execute sale deeds and enforce possession orders. Bhoosreddy emphasized the urgency of these proceedings, stating that the authority will be closely monitoring compliance with orders to hold defaulting developers accountable.

To streamline the process, UP-RERA has initiated a systematic referral system where any cases involving developers who fail to comply with possession orders will be sent to the courts with the secretary's approval. Bhoosreddy has reiterated that the aim is to safeguard the interests of homebuyers and ensure they receive their properties in a timely manner.

Furthermore, as part of the new initiative, the authority plans to impose significant penalties on developers who do not comply with orders regarding possession. These penalties will be enforced through the district magistrate, enhancing the authority's capacity to recover due amounts and address grievances effectively.
