The Haryana Real Estate Regulatory Authority (H-RERA) has been facing criticism from homebuyers over the slow pace of resolving their complaints. According to data shared by H-RERA, only 53% of the complaints submitted by homebuyers in the last five years have been resolved, while the rest are at various stages of review. This has led to a backlog of complaints and many homebuyers are now seeking justice through other authorities.
The Haryana Real Estate Regulatory Authority (H-RERA) has been facing criticism from homebuyers over the slow
pace of resolving their complaints. According to data shared by H-RERA, only 53% of the complaints submitted by
homebuyers in the last five years have been resolved, while the rest are at various stages of review. This has led to a
backlog of complaints and many homebuyers are now seeking justice through other authorities.
Since February 2018, a total of 26,356 complaints were submitted before H-RERA, out of which only 13,133
complaints that were submitted physically at the authority's office were taken into consideration. The authority has
decided on 7,031 complainants so far, while around 6,102 are still pending before it. Of these pending complaints,
4,747 are pending before the court, with only 981 cases having their first hearing. The rest of the cases are still at
various stages of scrutiny, reply or reserved by the authority.
One of the reasons for the backlog is the increased awareness among homebuyers, which has led to a surge in the
number of complaints. Additionally, the ban on proceedings related to refund cases for over a year and pandemic-
related hindrances have also contributed to the backlog. H-RERA officials have stated that they are taking several
initiatives to ensure fair and quick redressal of the problems faced by homebuyers and developers. The authority has
set up a digital court to expedite the disposal of complaints.
However, despite these measures, the slow pace of complaint resolution has forced many homebuyers to seek justice
through other platforms. According to Vikram Singh, a homebuyer who invested in an affordable housing project in
Sector 62 six years ago and is still waiting for possession, the complaints before H-RERA are moving very slowly,
which gives developers time to manage irregularities. This leaves aggrieved homebuyers with no option but to
approach other authorities.
A city-based lawyer has stated that H-RERA should not take more than 60 days to decide on a complaint as per the
norms. However, it usually takes four to six months or even more to dispose of a complaint. This delay not only
causes frustration for homebuyers but also affects the real estate market's overall health.
It is essential that H-RERA takes steps to expedite the disposal of complaints and ensure that justice is delivered to
homebuyers in a timely and fair manner. This will not only restore homebuyers' faith in the authority but also boost
the real estate market's credibility. There should be a mechanism in place to monitor the progress of complaints and
ensure that they are resolved within a reasonable timeframe. Only then can the real estate sector in Haryana truly
flourish, with homebuyers and developers both benefiting from a transparent and efficient regulatory framework.
