A Mumbai sessions court has granted anticipatory bail to builder Sumit Jain in connection with an alleged fraud case linked to a redevelopment project in Lalbaug, providing him protection from arrest during the ongoing investigation.
The order was passed earlier this week by the sessions court, which considered the nature of allegations and the circumstances surrounding the case. The matter relates to a complaint filed with the DB Marg police station, where the complainant alleged that flats booked in a redevelopment project were not delivered despite payment.
According to case details, the complainant and her husband had booked two flats in the Lalbaug project in 2011, with a total transaction value of around INR 1.7 crore. The complaint alleged that despite financial commitments being fulfilled, the promised units were not handed over within the expected timeframe.
The court observed that the dispute involved elements of a civil nature, particularly relating to contractual obligations and project delivery. On this basis, it held that custodial interrogation of the accused was not necessary at the present stage of the investigation.
The grant of anticipatory bail ensures that the accused will not be taken into custody, subject to compliance with conditions set by the court. However, the investigation into the allegations will continue, and the case will proceed through the legal process.
The development reflects a recurring pattern in redevelopment-related disputes, particularly in Mumbai, where delays, contractual disagreements and financial claims often lead to both civil and criminal proceedings. Projects involving redevelopment of old buildings frequently involve multiple stakeholders, including developers, existing occupants and new buyers, increasing the complexity of execution.
