HRERA directs Chintels India to pay over INR 4 crore to homebuyer for construction defects

Synopsis

The Haryana Real Estate Regulatory Authority has directed Chintels India Pvt Ltd to pay over INR 4 crore as compensation to a homebuyer in Gurugram for severe construction defects in a residential project. The complaint highlighted structural issues soon after possession, which remained unresolved. The order follows a fatal tower collapse in the same project that exposed serious construction flaws. Authorities concluded the project was unfit for habitation. Along with compensation, the builder has been asked to refund additional charges and pay interest, while some claims such as rent and EMIs were not accepted.

The Haryana Real Estate Regulatory Authority (HRERA) has directed Chintels India Pvt Ltd to pay compensation exceeding INR 4 crore to a homebuyer in Gurugram over serious construction defects in a residential project in Sector 109.


The complaint was filed by Delhi-based Aruna Garg, who had purchased a 4 BHK flat in Tower C of the project. She had paid around INR 1.8 crore, which was higher than the initially agreed price, and took possession of the unit in late 2019. Soon after moving in, multiple structural issues were observed, including broken tiles, uneven flooring, and cracks in the balcony and common areas. Despite repeated complaints, the developer did not address these concerns.

The issue gained wider attention after a portion of Tower D in the same project collapsed in early 2022, resulting in two fatalities and injuries to several others. Investigations conducted by the district administration and the Indian Institute of Technology Delhi found that high chloride content in the concrete had led to corrosion of the steel reinforcement, weakening the structure.

Experts assessed that the condition of the buildings had deteriorated to such an extent that repairs were neither technically viable nor financially practical. HRERA, in its order, noted that the entire project was uninhabitable and held the developer solely responsible. It also observed that the buyer had relied on assurances of high-quality, international-standard construction at the time of purchase.

Taking into account the rise in property values in Sector 109, the authority calculated compensation at INR 13,000 per sq ft and directed the builder to pay INR 4.09 crore to the complainant. The amount will carry an annual interest of 10.8 per cent until full payment is made.

In addition to this, HRERA ordered the developer to refund INR 4.6 lakh paid as stamp duty, along with INR 2 lakh as compensation for mental harassment and INR 50,000 towards litigation expenses. However, claims related to rent, EMIs, and other additional financial losses were not accepted.

The Chintels Paradiso project had come under scrutiny following the structural collapse, leading to increased regulatory focus on construction quality and compliance in Gurugram's residential developments. Authorities have since taken a stricter approach in similar cases involving safety concerns and builder accountability.
