BMC initiates e-auction against six properties over INR 455.48 crore tax dues

Synopsis

Brihanmumbai Municipal Corporation (BMC) has initiated e-auction proceedings against six properties in Mumbai for non-payment of property tax amounting to INR 455.48 crore. The civic body also issued 21-day final notices to two additional defaulters in the Fort area of south Mumbai. The identified properties are located in Goregaon (West), Bandra (West), Dahisar, Parel, Mazgaon and Malad-Kurar village. Authorities said attachment and distraint action has been taken under provisions of the Mumbai Municipal Corporation Act. If dues remain unpaid after movable assets are auctioned, immovable properties will be put up for sale in compliance with statutory provisions and a Bombay High Court interim order.

The Brihanmumbai Municipal Corporation (BMC) on Thursday initiated e-auction proceedings against six properties across Mumbai for non-payment of property tax dues amounting to INR 455,48,94,374, including penalties.


In a release, the civic body said that despite repeated notices, the concerned property holders failed to clear their outstanding dues, prompting the corporation to commence the e-auction process. The six properties identified for auction are located in Goregaon (West), Bandra (West), Dahisar, Parel, Mazgaon and Malad-Kurar village.

In addition to these six cases, the BMC has issued 21-day final notices to two other defaulters whose properties are located in the Fort area of south Mumbai. The extended deadline has been granted to enable the owners to clear their pending dues, failing which auction proceedings will also be initiated against them.

The two Fort properties include a residential-cum-hospital premises with tax arrears of INR 21.03 crore and a commercial property with outstanding dues of INR 13.47 crore. Officials said that if the dues are not cleared within the stipulated period, the civic body will proceed with further recovery measures as per law.

The action forms part of a special drive undertaken by the BMC's Assessment and Collection Department against major property tax defaulters. As part of this drive, attachment and distraint proceedings were carried out on eight properties across the city. These properties include open plots, residential land parcels, commercial units, industrial premises and a hotel.

The civic body stated that the action has been taken under relevant provisions of the Mumbai Municipal Corporation Act, particularly Sections 203 to 206, which empower the corporation to recover unpaid property taxes through attachment and sale of assets.

According to an official, the recovery process will follow due procedure. Initially, movable assets located on the premises will be attached and auctioned. If the outstanding dues remain unrecovered after this step, the immovable property itself will be put up for auction.

The official added that the process will be conducted in accordance with statutory provisions and in compliance with an interim order issued by the Bombay High Court in Writ Petition No. 2592 of 2013.

The BMC has been intensifying efforts to improve tax recovery and strengthen municipal revenues, particularly from large defaulters, as property tax constitutes a significant source of income for the civic body's infrastructure and public service projects.
