Hong Kong has formally condemned Panama's Supreme Court decision that annulled CK Hutchison's long-term concession to operate the Balboa and Crist bal container terminals at the Panama Canal. Officials highlighted the substantial investments and employment created by the company, warning that the ruling could harm Panama's business environment and investor confidence. CK Hutchison has initiated international arbitration against the decision. Panama's president defended the judiciary's independence, emphasizing national sovereignty, while China expressed concern over the potential economic and diplomatic fallout from the ruling.
Hong Kong's government has raised strong objections to Panama's Supreme Court decision that voided the contract of CK Hutchison's subsidiary, Panama Ports Company, to operate two major container terminals at the Panama Canal. The Balboa and Crist bal ports have been under CK Hutchison's management for several decades, with the original concession granted in the late 1990s and extended in 2021.
The Secretary for Commerce and Economic Development of Hong Kong, Algernon Yau Ying-wah, summoned Panama's Consul General, Jose Ramon de Jesus Varela Fabrega, to express strong dissatisfaction and opposition to the ruling. He emphasized that CK Hutchison had made significant investments in infrastructure, provided numerous jobs, and contributed to Panama's economic development over many years. Yau warned that the court's action could damage the country's credibility, weaken its business climate, and undermine adherence to international trade norms. He also called for a fair business environment and proper treatment of foreign investors operating lawfully in Panama.
China's Hong Kong and Macau Affairs Office had earlier warned Panama of heavy prices over the decision, reflecting Beijing's concern about its impact on Chinese and Hong Kong investments abroad. Panama's President, Jose Raul Mulino, described the court's ruling as definitive and underscored that Panama would not be influenced by external pressure. He stressed the country's dignity and its sovereign right to uphold independent judicial decisions.
CK Hutchison has responded by initiating international arbitration to challenge the annulment. This step is part of the company's broader strategy to protect its legal and commercial interests, especially as it plans a global ports sale valued at around USD 23 billion. The dispute has drawn attention to Panama's port policy, with the president indicating that future contracts would avoid exclusive arrangements with single operators to enhance competition and national oversight.
The ruling comes amid scrutiny of the extension of CK Hutchison's concession and past audits, which had raised questions about compliance and procedural irregularities. Analysts note that how this dispute is resolved could influence investor confidence in Panama and shape the future management of its strategically important canal ports.
