DTCP halts property registrations for commercial colony in Gurugram

Synopsis

The Department of Town and Country Planning (DTCP) has stopped the registration of sale, lease and conveyance deeds for a commercial colony in Gurugram's Sector 53 after finding that the project licence had expired and was never renewed. The licence, issued in 2002 for nearly 3.95 acres, lapsed in 2005. DTCP also noted unpaid statutory dues of about INR 87.6 lakh. Enforcement authorities have directed revenue officials to flag violations and asked police to initiate legal action against the developers.

The Department of Town and Country Planning (DTCP) has barred the registration of sale, lease and conveyance deeds for a commercial colony located in Sector 53 of Gurugram after identifying long-pending violations related to licence renewal and statutory payments. The department stated that the development licence issued for the project had expired and was not renewed, making all related property transactions legally untenable.


According to DTCP records, licence No. 13-19 of 2002 was granted for developing a commercial colony spread across approximately 3.953 acres. The licence expired in 2005, but the developers failed to apply for renewal even after repeated provisions under planning regulations. The licence was held by Arenas Infotech Pvt. Ltd. and Senior Builders Pvt. Ltd.

The department further found that statutory dues amounting to around INR 87.6 lakh, along with applicable interest, remain unpaid. These dues include licence fees and other charges payable under the Haryana Development and Regulation of Urban Areas Act, 1975. DTCP officials indicated that non-payment of these amounts compounded the violation and led to stricter enforcement action.

The district town planner (enforcement), Amit Madholia, directed sub-registrar offices to stop registering any deeds related to the property. Revenue authorities were instructed to make red entries in land records to reflect the licence lapse and ongoing violations. DTCP also asked police authorities to initiate legal proceedings, including registration of a first information report against the owners and directors of the two companies.

Officials explained that police action has been sought for alleged breaches of licence conditions, bilateral agreements signed with the department, and specific provisions of the 1975 Act. The department noted that similar steps are being taken in other cases where commercial or residential licences have expired but developments continued without renewal.

DTCP clarified that the restriction on registrations will remain in place until the developers regularise the licence status and clear outstanding dues. Any further action, including recovery proceedings or prosecution, will depend on the outcome of investigations and the response of the companies involved.
