The Haryana Real Estate Regulatory Authority (RERA), Gurugram-bench, has issued an advisory urging homebuyers and property investors to conduct transactions only through agents who are registered with the regulator, emphasising the legal and financial risks of engaging unregistered intermediaries. According to the advisory, unregistered agents may make misleading assurances that can lead to disputes and complications later in the transaction process, thereby exposing buyers to potential loss and legal issues. The authority clarified that under the Real Estate (Regulation and Development) Act, 2016, no individual may facilitate the sale or purchase of property in a RERA-registered real estate project without proper registration. It further highlighted that the definition of a real estate agent under the Act encompasses brokers, dealers and other intermediaries who negotiate or introduce buyers and sellers for remuneration. Homebuyers have been advised to verify credentials against the official Gurugram RERA register to enhance transparency and protect their interests.
The Haryana Real Estate Regulatory Authority (RERA), Gurugram-bench, has formally advised homebuyers and property investors to deal exclusively with real estate agents who hold valid registration with the authority, underscoring that engaging unregistered intermediaries can invite legal and financial complications. The advisory stressed that unregistered agents frequently employ misleading or false assurances to attract buyers, which may subsequently lead to disputes or complexities in property transactions.
Under the Real Estate (Regulation and Development) Act, 2016, no real estate agent is permitted to facilitate the sale or purchase of property in a real estate project that is registered with the concerned regulatory authority unless they have themselves obtained registration. The authority clarified that the statutory definition of a real estate agent is comprehensive, covering any individual who negotiates or acts on behalf of another person in a property transaction, or introduces buyers and sellers for the sale or purchase of plots, apartments or buildings, in exchange for remuneration or commission. This broad definition includes property brokers, dealers and middlemen, irrespective of the nomenclature under which they operate.
Gurugram RERA also highlighted that Section 9 of the RERA Act mandates compulsory registration of real estate agents with the respective state authority. Any person acting as a real estate agent without such registration is legally ineligible to sell, advertise or facilitate the sale of a property in a registered real estate project. The advisory warned that transactions conducted through unregistered agents may not be recognised under the Act, potentially leaving buyers without legal recourse if disputes arise.
To safeguard their interests, homebuyers have been encouraged to verify the credentials of real estate agents before entering into any transaction by referring to the list of registered agents available on the official Gurugram RERA website. The authority stated that adherence to these guidelines is designed to promote greater transparency in property dealings, protect buyer interests and reduce the risk of fraudulent practices in the sector.
