Bright Star Hotels issued show-cause notice over alleged violations at Gurugram property

Synopsis

Bright Star Hotels Pvt Ltd has been served a show-cause notice by the district town planner (enforcement) in Gurugram over alleged violations of building and land-use regulations at its hotel-cum-commercial complex in Sikanderpur Ghosi. The company has been asked to explain the deviations and submit relevant approvals, failing which coercive action, including demolition or sealing, may be initiated.

The District Town Planner (enforcement) in Gurugram has issued a show-cause notice to Bright Star Hotels Pvt Ltd, citing serious alleged violations of building norms and land-use regulations at its hotel-cum-commercial complex located in Sikanderpur Ghosi.


Under the notice, the company has been directed to appear before the enforcement authority and explain why action should not be taken for the alleged breaches under the Haryana Development and Regulation of Urban Areas Act. The firm has also been asked to submit copies of approved building plans, layout plans, occupation certificates and other statutory permissions related to the property.

According to the enforcement authorities, the land in question was granted change of land use permission in the mid-1990s for the development of a hotel-cum-commercial complex. However, it has been alleged that the company later subdivided the built structure into multiple units, including shops and office spaces, and transferred rights to third parties by selling these units without obtaining the mandatory licence required under applicable planning laws.

Officials have stated that such subdivision and sale of units, without prior approval, amounts to unauthorised development of a commercial colony. The notice has warned that failure to provide a satisfactory explanation could lead to coercive measures, including demolition of unauthorised portions, sealing of the premises or registration of a police case.

The company has been instructed to immediately stop any further alleged violations and to submit its response along with supporting documents within the stipulated period to avoid further enforcement action.
