Maharashtra scraps 2% monthly penalty on overdue property tax in smaller towns

The Maharashtra cabinet has introduced the 'Abhay Yojana' to waive the 2% monthly penalty on property tax arrears in small towns, aiming to reduce the financial strain on property owners and encourage timely payments. Additionally, amendments to local governance laws will allow a two-thirds majority of elected members to propose the removal of their president, with a special session to be convened within ten days for a vote. These measures will be enacted through an ordinance due to the legislature's recess.

The Maharashtra cabinet this week approved a proposal to eliminate the 2% monthly penalty on past-due property taxes in industrial townships, nagar panchayats, and municipal councils. This is a major step towards easing the financial burden on property owners in smaller municipalities. This initiative, introduced under the 'Abhay Yojana', seeks to encourage timely tax payments by reducing the cumulative penalty amounts, which often surpass the original tax dues, leading to payment delays.


The cabinet also sanctioned amendments to the Maharashtra Municipalities, Nagar Panchayats, and Industrial Townships Act, 1965. These changes empower two-thirds of elected members in local bodies to initiate the removal of their president. Upon receiving such a proposal, the district collector is mandated to convene a special session within ten days to conduct a vote on the matter.

Given that the state legislature is not currently in session, the government plans to implement these decisions through an ordinance.

This development follows previous efforts by the Maharashtra government to ease property tax burdens. Notably, in early 2022, the state approved a complete waiver of property tax for residential units up to 500 sq ft in Mumbai, benefiting over 1.6 million homes and resulting in a revenue loss of INR 462 crore. Similarly, the Thane Municipal Corporation passed a resolution in late 2021 to waive property tax for houses up to 500 sq ft, pending state approval.

By easing these financial burdens and enhancing local governance mechanisms, the state aims to foster a more compliant and responsive administrative environment. This initiative, alongside previous tax relief measures, underscores the government's commitment to supporting residents and promoting fiscal responsibility across Maharashtra.
