The ongoing construction activities within Navi Mumbai Municipal Corporation's (NMMC) jurisdiction have led to excessive noise and air pollution, primarily due to basement excavation. In response, the Hon'ble High Court of Mumbai passed an order in 2023 mandating pollution control measures. Based on this directive and public complaints, the NMMC, under the guidance of Municipal Commissioner Dr. Kailash Shinde, formulated and implemented a Standard Operating Procedure (SOP) on 1 August 2024. During inspections, violations of the SOP were identified, leading to notices being issued to 87 developers, with fines amounting to INR 1.40 crore collected. The NMMC is now taking stricter actions, including stop-work notices, against persistent offenders, reinforcing its commitment to pollution control.
The construction activities underway within the Navi Mumbai Municipal Corporation (NMMC) jurisdiction have been generating significant noise and air pollution, particularly due to basement excavation. Recognising the environmental concerns, the Hon'ble High Court of Mumbai, in a suo-moto petition (PIL No. 3/2023), issued an order in 2023 directing the implementation of measures to mitigate air and noise pollution.
Following the court's directive issued in December 2023 and addressing citizens' complaints regarding air and noise pollution caused by blasting activities, the NMMC, under the supervision and approval of Municipal Commissioner Dr. Kailash Shinde, developed a Standard Operating Procedure (SOP). This SOP was officially published and implemented on 1 August 2024 within the NMMC area, which falls under the Mumbai Metropolitan Region Development Authority (MMRDA).
Subsequent on-site inspections of ongoing construction projects within NMMC's jurisdiction revealed several instances of non-compliance with the prescribed SOP. Consequently, the concerned Sixth Commissioner and Divisional Officer issued notices to developers of 87 projects that failed to adhere to the SOP. As a result, penalty fees amounting to INR 1.40 crore were recovered from the violators.
However, certain developers were found to be in compliance with the SOP. Those found guilty of repeated violations will face stop-work notices, and stringent action will be taken against those who disregard the issued notices. The NMMC has been proactive in ensuring the effective implementation of pollution control measures, distinguishing itself among municipal corporations in the MMR region.
The Urban Planning Department of NMMC has reinforced its stance by affirming that mere penalty collection will not suffice. Stricter measures, including increased fine amounts and stop-work notices, will be imposed on developers who continue to flout the SOP regulations. These efforts underscore NMMC's commitment to sustainable urban development and ensuring a healthier environment for residents.
